Status is decided by how the relationship works in practice, not by the label on the contract: tribunals look at control, personal service and mutuality of obligation, following Acas guidance. Real cases weigh more factors than three questions can, which is exactly why the answer below is a starting point.

Under the Renting Homes (Wales) Act 2016, in force since 1 December 2022. England abolished its section 21 route in May 2026, while Wales kept this one, and from 1 June 2026 every occupation contract also carries new fundamental terms against discrimination over children or benefits. Community landlord routes, break clauses and estate management grounds carry their own rules.
